In Case No. 2011 CR 50, Misty Salem, age 30, of Stafford, was convicted of one count of misdemeanor battery upon the person of Tamara Osenbaugh and, also, one count of battery upon a law enforcement officer. These crimes took place during the Octoberfest in Stafford and consumption of alcohol was a contributing factor.

Salem was sentenced to serve 360 days jail, but this sentence was suspended and she was given 12 months of supervised probation. Conditions of probation will include observance of alcohol and drug conditions plus payment of costs exceeding $500.

A companion charge of battery upon a family member was dismissed in consideration of Salem pleading to the two misdemeanor.

2011 CR 50 Francisco Esparza, age 24. Of Macksville was convicted of sale of a controlled substance while possessing a firearm in the United States District Court for the District of Kansas, in Wichita. The controlled substance involved was cocaine and this sale took place in the parking lot of the Short Stop in St. John, back on February 8. Unfortunately for Esparza, the sale was made to an undercover law enforcement officer.

This case was originally charged in Stafford County District Court case 2011 CR 07. However, the Stafford County Attorney was successful in getting the United States District Attorney to file a federal charge concerning this same event. The significance of the federal charge is that the federal sentence would necessarily be about 3 and one half times greater than the state sentence. Upon conviction in federal court, the Stafford County case was dismissed.

Esparza was sentenced on November 23 to 60 months in a federal prison. He will then face probable deportation. If convicted in Stafford County District Court, Esparza would have probably received an 18 month prison term. Esparza has prior convictions in Stafford County District Court, for misdemeanor offenses.

In Case No. 2011 CR 52, Dustin Clark was convicted of disorderly conduct and sentenced to 30 days in jail and fine and costs in the amount of $655. Clark is 22 years of age and live in Stafford where this crime took place on the night of October 22.

In Case No. 2011 CR 54, Bo Vernon Schmidt was convicted of a Class A misdemeanor theft and sentnced to serve 90 days in  jail. This jail term was suspended and Schmidt will be on probation for the next 12 months. Conditions of probation include payment of restitution and costs in excess of $600. The other co-defendants with Schmidt have yet to be convicted. This theft took place in October of 2011 and it was from a rural farmstead in the southeast portion of Stafford County.
